Welcome to TrustVue ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our platform, website, and services (collectively, the "Service") operated by TrustVue, Inc.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

  • "Care Seeker" means an individual seeking care services for themselves or others.
  • "Caregiver" means an individual providing care services through our platform.
  • "Care Recipient" means an individual receiving care services.
  • "Platform" means TrustVue's website, mobile applications, and related services.
  • "User" means any person who accesses or uses our Service.

3. Eligibility

To use our Service, you must:

  • Be at least 18 years old
  • Have the legal capacity to enter into these Terms
  • Provide accurate and complete information during registration
  • Maintain the confidentiality of your account credentials

4. User Accounts and Registration

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.

You agree to immediately notify TrustVue of any unauthorized uses of your account or any other breaches of security.

5. Services Provided

5.1 Platform Services

TrustVue provides a platform that connects Care Seekers with Caregivers. Our services include:

  • Profile creation and management
  • Search and matching capabilities
  • Communication tools
  • Scheduling and calendar management
  • Payment processing facilitation
  • Background check services
  • Rating and review systems

5.2 TrustVue is Not a Care Provider

TrustVue is a technology platform that facilitates connections between users. We do not provide care services directly and are not responsible for the quality, safety, or legality of care services provided by Caregivers.

6. User Responsibilities

6.1 Care Seekers

  • Provide accurate information about care needs
  • Verify caregiver credentials and references
  • Ensure compliance with applicable laws and regulations
  • Pay for services as agreed upon with Caregivers
  • Maintain appropriate insurance coverage

6.2 Caregivers

  • Provide accurate credentials and experience information
  • Maintain all required licenses and certifications
  • Provide services with reasonable care and skill
  • Comply with all applicable laws and professional standards
  • Maintain appropriate insurance and bonding
  • Report any incidents or concerns promptly

7. Background Checks and Verification

TrustVue may provide background check services for Caregivers. However, Care Seekers are responsible for making their own decisions regarding the suitability of any Caregiver.

Background checks may not reveal all relevant information, and TrustVue makes no representations or warranties about the completeness or accuracy of such checks.

8. Payment Terms

Payment arrangements are made directly between Care Seekers and Caregivers. TrustVue may facilitate payment processing but is not responsible for payment disputes.

TrustVue charges service fees as disclosed at the time of use. All fees are non-refundable unless otherwise stated.

9. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

By using our Service, you consent to the collection and use of information in accordance with our Privacy Policy.

10. Prohibited Uses

You may not use our Service:

  • For any unlawful purpose or to solicit others to engage in unlawful acts
  • To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others
  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
  • To submit false or misleading information
  • To upload or transmit viruses or any other type of malicious code
  • To spam, phish, pharm, pretext, spider, crawl, or scrape
  • For any obscene or immoral purpose
  • To interfere with or circumvent the security features of the Service

The Service and its original content, features, and functionality are and will remain the exclusive property of TrustVue and its licensors. The Service is protected by copyright, trademark, and other laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

12. Disclaimer of Warranties

THE INFORMATION ON THIS WEBSITE IS PROVIDED ON AN "AS IS" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, TRUSTVUE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TrustVue makes no representations or warranties about the accuracy, reliability, completeness, or timeliness of the content, services, software, text, graphics, and links.

13. Limitation of Liability

IN NO EVENT SHALL TRUSTVUE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for all claims arising from or relating to the Service shall not exceed the amount you paid to TrustVue in the 12 months preceding the claim.

14. Indemnification

You agree to defend, indemnify, and hold harmless TrustVue and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

15. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service.

16. Governing Law

These Terms shall be interpreted and governed by the laws of the State of California, without regard to conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

17. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

18. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

IMPORTANT: TrustVue is not an emergency service. In case of medical emergencies, immediately call 911 or your local emergency services.
